NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
1) ELIGIBILITY: The AAA New Mexico 2015/2016 UNM Men’s Basketball VIP Fan Experience Sweepstakes (the “Promotion”) is open only to legal residents of New Mexico who are 18 years of age or older at time of entry (an eligible “Entrant”). Employees of AAA New Mexico, LLC (the “Sponsor”), employees of the University of New Mexico (“UNM”) and of each prize provider, and each of its respective parents, affiliates, subsidiaries, related companies, and the immediate family members of such employees (spouse, parents, children and siblings, and each of their respective spouses regardless of residence) and household members of each, whether related or not, are ineligible. Void outside New Mexico and wherever prohibited by law.
2) GRAND PRIZE: One (1) Grand Prize – Approximate retail value of prize: $200.00
- Four (4) UNM VIP Seats to the UNM vs. San Diego State game on March 1, 2016 (the “Game”).
- One (1) VIP Parking Pass for the Game.
- (4) Four VIP Tour of The Pit (UNM Arena) and Lobo Practice/Training Areas
- On-court Access during Player Shoot Around before the Game.
- One (1) Autographed Basketball by Coach Neal
3) HOW TO ENTER: You may only enter in the following ways: To enter, go to www.GoLobos.com, click on the AAA Insurance Lobo Basketball VIP Experience banner ad and complete the online entry form. Limit one entry per household. Entries must be received no later than midnight ET February 15, 2016 Official Entries may be subject to verification prior to or after prize drawing. Only Official Entries will be included in the prize drawing. All entries become the property of the Sponsor and will not be returned. Eligible Entrants may be contacted by a AAA representative regarding its products and services.
4) PRIZE RESTRICTIONS/CONDITIONS: All prize components are nontransferable, nonrefundable, and may not be sold. No cash or 2 other prize substitution is allowed for any prize, except by the Sponsor, in whole or in part, due to unavailability of the featured prize. Winner is solely responsible for all applicable income taxes relating to acceptance and use of any part of a prize. Grand Prize does not include any air or other transportation to or from winner’s residence to departure cities or hotels location unless stated otherwise. All meals, taxes, upgrades, gratuities, excursions, transfers, baggage fees, optional insurance and all other expenses not specified herein are the sole responsibility of the winner. All prize components subject to restrictions and conditions as described on the certificates and tickets.
5) DRAWING: Actual odds of winning will depend upon the total number of eligible Official Entries received from eligible Entrants. The Grand Prize will be awarded provided there is at least one Official Entry submitted by an eligible Entrant when the drawing for that Prize occurs. The Grand Prize Drawing will be conducted on or about February 15, 2016, by an employee of Sponsor from among all eligible Official Entries timely received. The drawing will take place at the Administrative Offices of Sponsor. Winner will be selected in a random drawing from all Official Entries timely received from eligible Entrants. Eligible Entrants need not be present at the time of the drawing in order to win.
6) ADDITIONAL TERMS: Winner of the Grand Prize will be required to complete, sign, have notarized and return an Affidavit of Eligibility and a Liability Release, and where legal, a Publicity Release, within a specified time. If not timely returned, the prize will be forfeited and awarded to an alternate winner. Any guest accompanying prize winner will be required to sign and return a release of liability/ publicity within a specified time. If winner’s guest is a minor, he/she must be accompanied by his or her parent or legal guardian who must sign and return a Liability Release and, where legal, a Publicity Release within a specified time. Failure to timely return documents or return of prize notification or prize as undeliverable will cause prize to be forfeited. By participating, each Entrant agrees a.) to abide by these Official Rules, and the decisions of the Sponsor, which shall be final and binding in all respects; b.) to release, discharge and hold harmless Sponsor, UNM, each prize provider, and each of their respective affiliates and subsidiaries and each of their respective employees, directors, officers, members, owners, partners, agents, representatives, successors and assigns (collectively “Releasees”), from all liability claims or damages arising, directly or indirectly, out of the entrant’s or the entrant’s guest participation in the Promotion and their acceptance, use or misuse of any prize, including any travel related thereto, and c.) by acceptance and use of any part of any Prize, to the use of their names, photos, and/or likenesses for advertising and publicity purposes without further compensation and, upon request, will provide written consent to such use. Sponsor reserves the right, in its sole discretion, to disqualify any individual believed to be tampering with the entry process. Any attempt by an Entrant or any other individual to deliberately undermine the legitimate operation of this Promotion is a violation of criminal and civil law, and should an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.
7) LIMITATIONS OF LIABILITY: Sponsor and their agents are not responsible for any late, lost, incomplete, illegible or misdirected entries, nor are they responsible for incorrect or inaccurate information utilized in the Promotion. If for any reason the Promotion cannot be conducted as planned for any reason or any other cause which, in the sole opinion of the Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend this Promotion and randomly award the Grand Prize from among all eligible entries received prior to action taken by Sponsor. In no event will Sponsor and/or Releasees be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out the acceptance or use of a Prize or any component thereof. In the event of a dispute regarding the identity of the eligible Entrant submitting the selected winning Official Entry, the Sponsor shall decide who the winner is and such decision shall be final and binding.
8) GOVERNING LAW: CONSENT TO JURISDICTION: The Promotion shall be governed by the laws of the State of New Mexico without regard for choice of laws or conflicts of laws principles. Any and all disputes or claims arising out of or connected in any way with the Promotion will be resolved individually and exclusively by final and binding arbitration administered by the American Arbitration Association (the “AAA”) and conducted before a sole arbitrator pursuant to the Code of Procedure established by the AAA. The arbitration shall be held in Bernalillo County, New Mexico. The arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules. There shall be no authority for any claims to be arbitrated on a class or representative basis; arbitration can decide only Entrant’s and/or the Sponsor’s or a prize provider’s individual claims and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; provided, however, that if this sentence is declared invalid or unenforceable, either in whole or in part, the remaining sentences of Section 9 shall remain in full force and effect. The arbitrator shall not have the power to award special, consequential, incidental, exemplary, punitive or other similar damages against the Sponsor or any prize provider. If any part of this arbitration provision is deemed to be invalid or otherwise unenforceable or illegal, the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid or illegal provision were not contained herein, except that any such invalid or illegal provision shall be enforced to the greatest extent permitted by law. Notwithstanding anything contained herein to the contrary, the Sponsor or any prize provider may seek to obtain injunctive relief against an Entrant for the breach or threatened breach of these Official Rules, without posting bond, in addition to any other remedies in law or equity, which may be available to the Sponsor or prize provider, in any of the federal or state courts located in New Mexico. Each Entrant consents to jurisdiction and venue in the federal or state courts located in Bernalillo County, State of New Mexico for the purposes set forth above and/or to confirm any award obtained by the Sponsor or a prize provider in arbitration.
9) OFFICIAL RULES/WINNERS LIST REQUESTS: For the names of the winners of the Grand Prize, mail a self-addressed, stamped envelope to: AAA New Mexico, c/o Automobile Club of Southern California – UNM VIP Fan Experience Sweepstakes, Attention Diana Masur A153 – PO Box 25001, Santa Ana, CA 92799. This request must be received by February14, 2016. Winners’ names will be available on or about
